MOTIONS AGAINST THE COMPLAINT

Either in the answer, or in a separate motion, the defendant may attack the validity of the Complaint in a number of different ways under Nevada Rules of Civil Procedure Rule 12(b). This rule lists the following defenses: (1) lack of jurisdiction over the subject matter; (2) lack of jurisdiction over the person; (3) insufficiency of process; (4) insufficiency of service of process; (5) failure to state a claim upon which relief can be granted; (6) or failure to join a necessary party under Rule 19.
